1. Acceptance of Terms

By accessing this website or engaging any services provided by SiteBoom.com  ("Site Boom," "we," "our," or "us"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

2. Services
Site Boom provides digital marketing services, including but not limited to all services listed on this website, such as website hosting, search engine marketing, email hosting, social media marketing, email marketing, and Google marketing. The scope, timeline, and deliverables of services will be defined in a separate written agreement, proposal, or invoice between you and Site Boom.

3. Payments and Late Payments
A three (3) day grace period applies to all subscription-based services provided by Site Boom. If payment is not received within the grace period, services may be temporarily suspended until payment is made.

To reinstate suspended services, payment arrangements must be made with a Site Boom representative via email or telephone. Any payment made after service suspension will incur a twenty percent (20%) late/reconnection fee per affected service.

‍Example: $50 + 20% = $60.00

Payments may be made upfront, monthly, or according to a mutually agreed-upon payment arrangement. All payments are non-refundable.

Invoices paid via PayPal or Stripe are subject to a three percent (3%) processing fee charged by the various payment processors. To avoid this fee, payments may be made via Cash App, Chime, or Apple Pay where available.

Payment Plans: Hosting payments for done for you website design services are due upon the project's design completion. By engaging Site Boom design services, the user agrees not to withhold hosting payments or delay payments under any circumstances in accordance with prior agreements and initial terms of engaging services. Hosting payments withheld past 7 days of a website design project's completion will incur a $25 fee per weekly period beyond the intial grace period in order to activate and publish the users website. Overdue website hosting plan payments willfully withheld beyond 30 days will result in the forfeit of access to the design project with no remedy to recover initial service payments, nor will the project be subject to refunds on services rendered. By engaging Site Boom design services, website design client acknowledges and accepts these terms and conditions and waives any rights to refunds, legal remedies, or arbitration.

4. No Guarantees
Site Boom does not guarantee any specific outcomes, results, or performance metrics from the use of its services unless performance guarantees are given in writing on a service by service case basis. While we commit to providing services with professionalism, due diligence, and best efforts, results may vary based on factors outside our control, including but not limited to industry conditions, competition, market changes, and client participation or implementation.

5. Refund Policy
All payments made to Site Boom are non-refundable.

‍Month-to-Month Plans: No refunds under any circumstances.
Annual Subscriptions: A fourteen (14) day refund period applies from the initial payment date only.

Once payment is received, resources are allocated immediately. By engaging our services, you acknowledge and agree that you waive any rights to chargebacks, arbitration, or financial remedies beyond those expressly stated in these Terms.

6. Intellectual Property
Unless otherwise agreed upon in writing, all intellectual property created by Site Boom, including but not limited to website designs, content, graphics, code, and marketing materials, remains the sole property of Site Boom. Limited usage rights may be granted upon full payment, as outlined in a separate agreement.

7. Limitation of Liability
To the fullest extent permitted by law, Site Boom shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our services, website, or these Terms and Conditions.

8. Termination
Either party may terminate services for any reason by providing five (5) days’ written notice after the start of a project. Upon termination, all outstanding balances become immediately due, and the client must cease use of all Site Boom services and materials unless otherwise agreed in writing.

9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

10. Amendments
Site Boom reserves the right to update or modify these Terms and Conditions at any time. Changes will become effective immediately upon posting on this website. Continued use of the website or services constitutes acceptance of the revised terms.
